Companies enquire about the status of a probiotic strain that will be incorporated in food or beverage. It is essential for the supplier of probiotic to show Generally Recognized As Safe (GRAS) status of the strain. Companies need to make sure that the strain is GRAS for the usage in food in beverage products. Though scientific studies have proven that a probiotic strain offers certain benefits, companies need to ensure that studies apply to food or beverage in which strain is incorporated. In addition, they also need to ensure that there will be enough amount of colony-forming units (c.f.u.s) of probiotic strain to offer its benefits.
Suppliers are instrumental in showing that their probiotic ingredients are GRAS and can be used for many products and purposes. Justin J. Prochnow, a lawyer and shareholder for Greenberg Traurig, L.L.P., mentioned a lot of regulations regarding GRAS in the presentation at Ingredient Marketplace in Orlando. He said, “That’s a big advantage because they can go out and market that and say, ‘Hey, you can use this. You don’t have to go out and get your own GRAS report. We’ve already established it as GRAS.’”

He also added that food and beverage manufacturers are not entitled to make any claim that the ingredient or product can treat, diagnose, or cure any disease. Food governing bodies are paying attention to those claims. He also mentioned about a petition that requested to enlist amount of probiotic ingredients in terms of c.f.u.s instead of mg. The petition was filed by the International Probiotics Association to the F.D.A. in November, 2017.
There may be two dietary supplements which have 50 grams of probiotic ingredients but have less number of c.f.u.s and it is not beneficial for consumers. The comment period on the petition closes on May 17, 2017. Law firms buy products from retail stores and check whether it meets label claims. If not, they send letters to companies and companies end up settling with them. For few hours of work, they could earn significant amount of money. So, Prochnow also emphasized on compliance with regulations.
