EndoCapsule Gets FDA Clearance

Endo Capsule by OlympusOlympus Medical Systems has received marketing clearance from the FDA for its EndoCapsule endoscope system, reports the Globes. We covered this endoscopic system in two previous posts: May '05 Capsule Endoscope by Olympus, and Oct '05 Olympus Launches High-resolution Endo Capsule System in Europe.

The EndoCapsule system is now the main competitor to a highly successful PillCam capsular endoscopy system from Israel's Given Imaging. Gil Shlomo of the Globes believes that in the short term, this development will deal a blow to Given's market domination, because of Olympus's strong marketing reach. In the long term, the outlook for both companies is good, since a large world-wide company like Olympus will expand the horizons of the capsule endoscopy market, and the technology will find greater acceptance among clinicians and patients alike.

What's also not clear is whether Given will follow up on its earlier warning to litigate Olympus for alleged infractions of its patents.

Olympus and Given have a law suit already filed.

Olympus and Given are going for Jury trial in Nov.2008.Microgizzmos which owns patent#7039453 with broad claims for Capsule Endoscopy is likely to file a law suit.

www.givenimaging.com has information on the lawsuit--SEC filings.
www.microgizzmos.com has the information about the broadest patent inventing co.They own US patent# 7039453 which covers the Given Imaging PillCam and EndoCapsule sold in USA.Infringement law suit is likely unless licensed.According to 3rd quarter,2007 report by Given Imaging--they spent 2.7 million$ for legal expenses in that quarter.

Given Imaging is expected to receive FDA approval for Colon Capsule soon which expands the market for this technology.Given Imaging realizes that it cannot bank on patents where their patent is weaker than Microgizzmos patents,but market thrust where it is 3 years ahead of Olympus Corp.The potential opportunity in Colonoscopy is very huge--perhaps 3 -5 times bigger.

Gil Shlomo of Globe is making a good point.Olympus will add to the use of Capsule Endoscopy.Sayaka by RF System Lab. of Japan is also working on this Capsule introduction in Japan and US.Mullick,Dutta have filed 140 claims for Capsule that will enhance its expanded use.Stanford Univ.researchers are also doing lot of research to enhance the Capsule.
